Prop 8 appeals

UPDATE: Proposition 8 is considered unconstitutional. The decision should be kept with a void of the amendment if you ask those who are for prop 8.

Chief U.S. District Judge Vaughn Walker is slated to release his ruling today on Proposition 8. Supports of prop 8 think have planned an appeal in case it doesn’t end in their favor. If they need to, opponents of the Prop 8 will appeal the case as well. The things the ruling will affect range from civil rights to the California state budget.

The basics of Prop 8

2008 was when the California Marriage Protection Act, or Prop 8, was passed. Because of the voter-added ballot proposition, marriage in California is legal only when made between a man and a woman. When Proposition 8 passed, it overturned the California Supreme Court ruling that legalized gay marriage. The campaign for Proposition 8 spent $ 39.9 million, while the campaign against Prop 8 spent $ 43.3 million.

Prop 8 challenges with federal government

Prop 8’s federal court challenge was placed in San Francisco. Perry v. Schwarzenegger was filed in court after Strauss v. Horton was held up. California constitution doesn’t violate equal protection with prop 8, if you ask a proponent that is. Opponents to Proposition 8 are arguing that constitutional guarantee to equal protection is being violated.

Prop 8 decision being appealed

There are already reactions being seen on the Prop 8 decisions. Supporters of Proposition 8 have filed an injunction, asking for a stay on marriage should the ruling be found against them. Marriage between those who are same-sex can’t happen under this until the case is entirely done. Opponents will file appeals if the ruling is against them also. National money will be spent entirely on Prop 8 for the next little while till the case closes. States that are allowing gay marriage are doing much better than others right now.
